CHRISTIAN, Judge.

The offense is murder; the punishment, confinement in the penitentiary for five years.

It was charged in the indictment, in substance, that appellant, with malice aforethought, killed Jonas Nabors by shooting him with a gun.

Appellant, who is a white man, was engaged in the taxi-cab business in the City of Longview. Deceased, who was a negro, ran a shoe-shining establishment, and also operated his automobile in hauling negro passengers for pay.
