This suit was instituted in the Lawrence county circuit court, May 29, 1907. The cause was in the St. Louis Court of Appeals on a former appeal, and is reported in 125 Mo. App. 41, 102 S. W. 605. After the former appeal had been disposed of, this case was instituted.
In the former case the pleadings were silent as to any. subsequent modification of the original contract, and the trial court held that evidence of such modification was not admissible.
