— This is an action of trespass. The plaintiff and defendants occupied adjoining farms in the *23town of Southport, in this county. In November, 1874, a quantity of corn and beans on the lands occupied by the plaintiff were destroyed by cattle. It was a question of fact for the court below to pass upon, and there was evidence tending to show that the cattle were the property of, or in possession and under the control, of the defendants, and that defendants’ cattle done the damage complained of.
