FOLSOM, District Judge.

Before this Court is Defendant Panola-Harrison’s Motion for Summary Judgment. (Docket # 102). The Court has determined that this motion is well taken in part.

I. Background

Kevin Douglas Winn was fatally electrocuted while working for the Defendant, Panola-Harrison, Electric Cooperative, Inc., as a lineman. At the time of the accident, Panola-Harrison was a subscriber to Workers Compensation Insurance which covered Mr. Winn.
