In Kings county is now pending an action for the annulment of a marriage in which this intervening defendant, Blanchard P. Atkinson, is plaintiff, and the plaintiff in this action, Isabelle E. Boyd or Atkinson, is defendant (Atkinson v. Atkinson, 217 App. Div. 96). Therein the issue is whether Isabelle, when she participated in a marriage ceremony with Atkinson, was already married to Robert H. Boyd, now one of the defendants here.
