This was an action to recover damages for personal injuries alleged to have been sustained through the negligent construction and operation of a street-railway system by the defendant in the city of Wichita. ,It appears from the petition and opening statement of counsel for plaintiff in error that the defendant came into possession of the property of the Wichita Electric-light Company, which had theretofore owned and operated a system of street-railway in said city.
