Appeal from an order of the Supreme Court (McCarthy, J.), entered October 31, 2006 in Albany County, which denied defendants’ motion for summary judgment dismissing the complaint.

*1238On January 24, 2003, plaintiff Karin L. Snow was operating her motor vehicle when she was struck from the rear by a motor vehicle operated by defendant Robert W Harrington.
