HAIGHT, Circuit Judge.

This suit is primarily instituted under an act of the New Jersey Legislature, entitled “An act to compel the determination of claims to real estate in certain cases, and to quiet the title to the same.” 4 N. J. Comp. St. p. 5399. The bill also contains allegations which, it is claimed, bring the suit within the general quia timet jurisdiction of a court of equity, irrespective of the statute. Accordingly it prays for a decree removing a cloud upon the title of the plaintiff to the land in question, alleged to have been created by a certain riparian grant made by the…
