This is an appeal from the third judicial district of the State of Montana, in and for the County of Powell from a judgment of conviction of the crime of kidnapping, with the intent to secretly confine rendered on October 29, 1959.

The fact situation in this matter is as follows:

On April 16, 1959, Lawrence M. Backman was employed as a correctional officer at the Montana State Prison. At about 4:00 p.m. on that day he was standing on a cat-walk on what is known as the old wing of the prison then relieving the officer on duty so he could eat his lunch.
