Lahtinen, J. Appeal from an order of the Supreme Court (Lebous, J.), entered October 29, 2003 in Broome County, which denied defendants’ motion for summary judgment dismissing the complaint.
On March 20, 2000, Albert L. Griffin (hereinafter decedent), while entering through a common area in the rear of a two-family house where he was a tenant, fell down cellar stairs. The 80-year-old decedent, who suffered from a variety of health problems, died the next day.
