This is a sequel to the case of Miller v. Kemp, decided September 17, 1931, and reported in 157 Va. 178, 160 S. E. 203, 206, reference to which is here made for full statement of the facts.
The case was remanded on November 16, 1931. Shortly thereafter, Kemp filed a petition and motion, alleging no additional facts but naming nineteen judgment creditors of J. It. Paschall, other than those named in his original answer and cross-bill.
