—In an action, inter alia, to recover damages for personal injuries, the defendant appeals, as limited by its brief, from stated portions of an order of the *815Supreme Court, Suffolk County (Tanenbaum, J.), dated June 23, 1995, which, inter alia, denied its motion for summary judgment dismissing the complaint.

Ordered that the order is reversed insofar as appealed from, on the law, with costs, the defendant’s motion for summary judgment is granted, and the complaint is dismissed.
