MEMORANDUM ORDER

Plaintiff Island Creek Coal Company (“Island Creek”) brings this action for declaratory and injunctive relief against defendants International Union, United Mine Workers of America; District 28, United Mine Workers of America; and Local Union 2232, United Mine Workers of America (collectively “UMWA”). Island Creek seeks to vacate an “enforcement penalty” of $1000.00 imposed *166by an arbitrator pursuant to the National Bituminous Coal Wage Agreement (“NBCWA”).
