Error to the Common Pleas of Lancaster county. This was an action of covenant by Benjamin M. Stauffer against the Inland Insurance and Deposit Company, upon a policy of insurance against fire, issued by the defendants on the 22d December 1856, whereby they insured the plaintiff for the term of four months, against loss or damage by fire, to the extent of $4000, on his stock of grain and flour, contained in a grist-mill, in Penn township, on the Chiques creek.

This was an action on a policy of insurance, and the defence was rested on an alleged non-compliance by the assured* with the conditions of the policy. One of those conditions was, that all persons assured sustaining any loss or damage, should forthwith give notice to the secretary of the company, or other authorized officer, and as soon as possible after, deliver in as particular an account of their loss and damage as the nature of the case would admit of, and produce to the company satisfactory proof thereof.
