Appeal by the People from so much of an order of the Supreme Court, Kings County (Lodato, J.), dated November 23, 1981, as granted the branch of defendant’s motion pursuant to CPL 330.30 (subd 1) which sought to set aside a jury verdict convicting defendant of two counts of promoting gambling in the first degree, and one count of possession of gambling records in the first degree.
