Plaintiff sued in assumpsit to recover commissions as tax collector, on real estate taxes collected by tbe County of Luzerne following the collector’s return of such taxes to the county commissioners. The action involved the returns and commissions for the years 1934 through 1938. The amounts involved were not in dispute. The case was tried by the court without a jury, resulting in judgment for the plaintiff, and the county appealed.
