MARTIN, Judge.

Offense murder, penalty five years in the penitentiary.

Appellant killed his father. He is the eldest of three children and was eighteen years old at the time of the tragedy. He claims to have killed in defense of himself and mother. The mother of appellant had on the day of the tragedy filed suit for divorce against deceased. The evidence indicates that prior to this she had had a very unhappy married life due to the drunken habits of the deceased. He had, according to her testimony, manufactured intoxicants in the home and when under their influence had made many brutal…
