DAVIDSON, Presiding Judge.

— Appellant was convicted of aggravated assault and battery, his punishment being assessed at a fine of $50.

The record is rather extensive in detailing the facts, but it discloses, in substance, that appellant had made a purchase of some hogs and carried them to the depot for the purpose of shipping them. The alleged assaulted party was J. D. Killough, the depot agent. Appellant approached him with reference to obtaining transportation for his hogs.
