The plaintiffs filed a suit for declaratory judgment alleging that they were purchasers of a tract of land under a real estate contract dated November 7, 1969. Both the City of Hickory Hills and the Village of Justice claimed that the property was located in their respective municipalities. Because the plaintiffs wished to build on the property and because they were unable to make proper application for zoning and building permits, they asked the court to declare which municipality had annexed the property.
