Appeal from the Circuit Court of the United States for the Southern District of Iowa. This was a proceeding in equity instituted by the independent district of Pella city against R. R. From the record in this case it appears that for some years prior to June, 1895, the First National Bank of Pella, a corporation created under the provisions of the act of congress known as the “National Bank Act,” carried on at Pella, Iowa, a banking business until about June 1,1895, when it ivas declared to be insolvent, and R. R. Beard, the appellant, was duly appointed receiver thereof by the comptroller of the currency.
