This case involves the thorniest of issues confronting local government. It is before us a second time and arises out of a citizens’ suit against the Rabun County Board of Commissioners and the Rabun County Hospital Authority (“the defendants”).

A group of Rabun County residents (“the citizens”) sued the defendants, seeking, among other things, a declaration that the defendants’ impending acquisition of a nonprofit hospital was void for failure to comply with the Hospital Acquisition Act (“the Act”).
