delivered the opinion of the court.
A petition to probate a will was-filed in the County Court of McHenry county. One of the witnesses to the execution of the will, Walter E. Healey, lived in Elgin, Kane county. The person who presented the petition for the probate of the will obtained from the clerk of the court a subpoena for the attendance of said witness, directed to the sheriff of Kane county to serve and the same was served upon Healey.
