DAUGHERTY, Judge.

Petitioners-Appellees, United States of America (Department of Energy), and Robert Gerring, (DOE) issued a subpoena to Respondents-Appellants, James E. Ferrell, Ferrellgas and Propane Industrial, Inc., (Ferrell).1 Ferrell refused to honor the same. DOE requested the United States District Court for the Western District of Missouri to enforce the subpoena. The District Court enforced the subpoena by its Order. Ferrell, seeking review of said Order by this Court, requests that said Order be reversed and vacated and the subpoena quashed.2 DOE requests on this appeal that said…
