The parties to this appeal will be referred to as plaintiff and defendant. ‘

Plaintiff, Hurtis Phelps sued W. E. Barron for $700.00 compensatory and $1000 punitive' damages for wrongfully cutting timber from plaintiff’s land in Pulaski County. Defendant’s answer and counterclaim denied wrongfully cutting the timber and sought to recover $3,000 for lumber and logs which it is alleged plaintiff wrongfully deprived defendant. A jury trial resulted in a verdict for plaintiff in the sum of $200 and from the judgment awarding plaintiff that sum and dismissing the counter claim,…
