Appeal from a judgment of the County Court of Ulster County (Bruhn, J.), rendered February 26, 2004, which resentenced defendant following his conviction of the crime of criminal possession of a controlled substance in the fourth degree.

Defendant waived indictment and was charged in a superior court information with the crime of criminal possession of a controlled substance in the fourth degree. He pleaded guilty to this charge and waived his right to appeal.
