MeDERMOTT, Circuit Judge.
On July 15, 1919, the appellee (defendant below) delivered to the Choctaw Portland Cement Company its written proposal to sell “One 42"x48" Traylor Bulldog Self-aligning *784Jaw Crusher,” delivery f. o. b. factory. The proposal provided:
