The named plaintiffs have brought this action on behalf of themselves and all other purchasers 1 of homes in Washington, D. C. whose mortgages are insured under the Federal Housing Administration’s (FHA) Existing House Program of § 221(d)(2) of the National Housing Act, 12 U.S.C. § 17152(d)(2) (1970). 2 The plaintiffs basically seek a declaratory judgment that § 221(d)(2) obligates the defendants, the Secretary of the Department of Housing and Urban Development (Secretary), the Commissioner and local director of FHA, and the United States, to require,…
