The judgments were recovered against the judge of probate on March 19,-1924, before the present Code went into effect on August 17, 1924. See Govern- or’s proclamation. Hence the provisions of ■section 1491 of the Code of 1907 governed, and not the further limitations contained in •section 2603 of the'Code of 1923, as follows:
“ * * * But ga¡|j iien js discharged at the end of one year after the expiration of the term of office of the principal if no unsatisfied judgment exists against said bond, and no suit is pending thereon.”
