This is an action to cancel a contract of life insurance with disability benefit, on the ground of fraud in the application for reinstatement — the policy being issued in 1926. Plaintiff appeals from an adverse judgment.
The contract had the following provisions: “All premiums are payable in advance at the Home Office, or to any Agent or Cashier of the Society upon delivery on or before their due date, of a receipt signed by the President, a Vice-President, Secretary or Treasurer, and countersigned by said Agent or Cashier”; the payment of a premium “shall not maintain this policy in…
