*992Appeal from a judgment (denominated order) of the Supreme Court, Monroe County (Eugene W Bergin, J.), entered October 15, 2002 in a proceeding pursuant to CPLR article 78. The judgment granted the petition and directed respondents to resume paying supplemental benefits to petitioner pursuant to section 8B-5 (C) of the Charter of the City of Rochester.

It is hereby ordered that the judgment so appealed from be and the same hereby is unanimously reversed on the law without costs and the petition is dismissed.
