This case began when several employees of the Dunbar & Sullivan Dredging Company (“Dunbar”) sued the United States in five separate suits for damages under the provisions of the Federal Tort Claims Act, 28 U.S.C. §§ 2671-80 (1988). 1 The plaintiffs in these suits were injured in a construction project undertaken by the United States Department of Army, Corps of Engineers (the “Corps”).
