This is a diversity action brought by Metropolitan Bank and Trust (“Metropolitan” or “the Bank”) on behalf of Plaintiff U.S. Bank Trust National Association. There are nine Counts in the Second Amended Complaint and a single issue in the Amended Counter-Cdmplaint which are still viable. By separate Order, JUDGMENT will be ENTERED as follows:
