This case is before the Court on writ of error from a judgment of the Circuit Court of Hills-borough County sentencing the plaintiffs in error to death for the murder of Joe B. Johnson.

The evidence shows that Joe B. Johnson, a well to do citizen of Tampa, was shot and killed on the night of Sunday, January 18th, 1931, near midnight, while he was putting his automobile in a garage in the rear of Crescent Apartments in Tampa.
