MEMORANDUM DECISION

WERKER, District Judge.

The petitioner in this action, Jose Leon (“petitioner”), was convicted of the crimes of possession of a weapon as a felony and possession of a dangerous drug in the fourth degree on February 7, 1974, after a six-day jury trial in Supreme Court, New York County, before the Honorable Morris Aarons.
