This is an action to recover damages for death caused by the overturning of the body of a motor-truck owned by the defendant, at the time being used under a gratuitous loan. The only negligence charged is that the body of the truck was defective, rotten, and unfit for use. This truck, loaded with twelve to fifteen young men, was being driven at a reasonable speed and with due care around a street corner.
