The question presented in this appeal is whether the statute of limitations has been tolled by acknowledgment of an alleged debt. Plaintiff brought an action in assumpsit against defendant to recover for the pur chase of stock. A nonsuit was entered by the trial judge. Motion to remove nonsuit was refused, and plaintiff has appealed.

Plaintiff by this action instituted on February 25, 1941, has sought to recover from defendant $890 with interest from September. 25, 1933. In his statement of claim he averred that on September 25, 1933, he purchased “at the special instance…
