This appeal concerns a dispute between an insured and its' insurer. The insured, plaintiff EmbroidMe.com, Inc. (“Em-broidMe”), was sued in federal district *1102court based on alleged copyright infringement. Luckily for EmbroidMe, it had an insurance policy with defendant Travelers Property Casualty Company of America (“Travelers”) in which Travelers agreed to indemnify EmbroidMe should the latter be deemed liable on this type of claim.
