This is a suit by Allan Troupe (hereinafter referred to as plaintiff) against Su-perx Drugs Corporation d/b/a Gasen Drugs (hereinafter referred to as defendant) for damages allegedly resulting from a false arrest caused by the defendant. Defendant appeals from a judgment entered pursuant *278to a jury verdict which awarded plaintiff $1000.00 actual damages and $5000.00 punitive damages for defendant’s instigation of plaintiff’s false arrest and imprisonment. We affirm in part and reverse in part.
