DAVIDSON, Judge.
Appellant was convicted of murder in the first degree, and his punishment assessed at confinement in the penitentiary for life. Appellant moved the court to continue the case to procure the testimony of an absent witness. The motion was overruled, but there was no bill of exception reserved to the ruling of the court. But one bill of exception appears in the record, which was reserved to the ruling of the court in regard to the testimony of Maggie May.
