Plaintiff alleged that on the 29th of June, 1917, it was the owner of *337all the pine timber upon certain described lands, and that on said date it entered into a contract with defendant by which the latter was granted the right to cut and log timber from said land, for which it was to pay at the rate of $6.50 per thousand on the 10th of each month for all timber cut the month preceding; that defendant had, during the months of November and December, 1918, cut and removed timber to the value of $4,-787.30, for which it had not paid, and that in addition thereto defendant was due it the sum of…
