Walter G. Carey, plaintiff in the court below, filed a malicious prosecution action against Bill Edwards Oldsmobile, Inc. (the Company), and William S. Edwards, Jr. (Edwards), defendants, for compensatory and punitive damages; the Company filed a counterclaim against Carey for $5,200.50, for the value of parts and services obtained by Carey for his personal use while employed by the Company. The account filed with the counterclaim showed certain credits in Carey’s favor, including the sum of $247 for wages payable to Carey and applied on the account.
