*383In this CPLR article 78 proceeding, petitioners Jean Heath, Ryland Gaines and Joseph Fritz request that the court declare erroneous, improper and contrary to law the determination of respondent Joan Johnson, Islip Town Clerk, which found invalid a petition for a referendum to establish a ward system for election of members of the Town Council. The proceeding was commenced by order to show cause dated November 2, 1995.
