Sellers was convicted of the unlawful possession of intoxicating liquor under Section 2613, Code 1942, and appeals.

He urges, among other contentions, that the evidence is insufficient to support his conviction. Since we have concluded- lie is correct in that contention we dicnss no other.

The question arises under these circumstances: On, and for some two years prior to April 9, 1946, Sellers operated in Picayune, Mississippi, a cafe.
