This action of trespass on the case was brought to recover damages for personal injuries which resulted when the plaintiff slipped on an icy sidewalk curbing occasioned, he alleged, by the negligence of the defendant. It was tried to a jury before a superior court justice and resulted in a verdict for the plaintiff in the sum of $6,500. The case is before us on the defendant’s bill of exceptions to the denial of its motions to pass the case, to the denial of its motion for a new trial, and to an evidentiary ruling made during the course of the trial.
