MAJOR, Chief Judge.

On June 24, 1946, Le Maire Cosmetic Co., Inc., an Illinois corporation (the debtor corporation) filed a petition in the District Court, praying that proceedings be had under Chapter X of the Bankruptcy Act, 11 U.S.C.A. §§ 501-676. On the same date, James E. Kennedy (appellee) was appointed Trustee and a preliminary order was entered enjoining and restraining Galsworthy, Inc. (appellant) from conducting a chattel mortgage foreclosure sale of machinery and equipment, of which the debtor corporation was alleged to be the owner.
