In this appeal, we determine whether the peremptory striking of a black person from the jury panel violated the rule first pronounced in Batson v. Kentucky, 476 U.S. 79 (1986), and extended to civil litigation in Edmonson v. Leesville Concrete Co., 500 U.S. _, 111 S.Ct. 2077 (1991). Other issues relate to jury instructions and to the admissibility of a witness’s prior consistent statement.
