delivered the following opinion:

This matter is before ns on the motion of Joaquin Cerra and L. Kivera y Kivera that the execution against them as bondsmen for the defendant be recalled and canceled, and their bond in the premises canceled and held for naught. Due oral argu*40ment was bad on tbe issue raised by the motion, and thereafter the United States attorney filed a brief in the premises.
