MEMORANDUM OF DECISION

DUPREE, District Judge.

This action was removed from the Superi- or Court of Nash County, North Carolina pursuant to 28 U.S.C. § 1441 because it pertains to the recovery of benefits under a plan established in conformity with the Employee Retirement Income Security Act of 1974 (ERISA), as amended, 29 U.S.C. §§ 1001, et seq. The United States district courts are given original jurisdiction over such actions by 29 U.S.C. § 1132(e)(1).
