Appeal from a judgment of the superior court for What-com county, Kellogg, J., entered March 26, 1910, upon sustaining a demurrer to the complaint, dismissing an action to-vacate a foreclosure sale.

On February 15, 1897, the appellants,, who are husband and wife, executed and delivered to the respondent J. M. Griffith a mortgage upon certain real property situáted in Whatcom county, to secure the payment, of the sum of $4,800, with interest, six months from date. The' debt evidenced by the mortgage was not paid at maturity, and proceedings were instituted to foreclose the same-on November 3, 1897.
