The defendant Elmer Hauff appeals from the order of the District Court of Sargent County denying his motion for judgment notwithstanding the verdict or in the alternative for a new trial. The appeal arises out of an action brought by the plaintiff, Allen Froemke, against the defendants, Elmer Hauff and DuWayne Kuehn, for damages for injuries he sustained as the result of an automobile accident.
